Personal data (usually referred to just as “data” below) will only be processed by us to the extent necessary and for the purpose of providing a functional and user-friendly website, including its contents, and the services offered there.

Per Art. 4 No. 1 of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to as the “GDPR”), “processing” refers to any operation or set of operations such as collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment, or combination, restriction, erasure, or destruction performed on personal data, whether by automated means or not.

The following privacy policy is intended to inform you in particular about the type, scope, purpose, duration, and legal basis for the processing of such data either under our own control or in conjunction with others. We also inform you below about the third-party components we use to optimize our website and improve the user experience which may result in said third parties also processing data they collect and control.

II. The rights of users and data subjects

With regard to the data processing to be described in more detail below, users and data subjects have the right to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data (cf. also Art. 15 GDPR); to correct or complete incorrect or incomplete data (cf. also Art. 16 GDPR); to the immediate deletion of data concerning them (cf. also Art. 17 DSGVO), or, alternatively, if further processing is necessary as stipulated in Art. 17 Para. 3 GDPR, to restrict said processing per Art. 18 GDPR; to receive copies of the data concerning them and/or provided by them and to have the same transmitted to other providers/controllers (cf. also Art. 20 GDPR); to file complaints with the supervisory authority if they believe that data concerning them is being processed by the controller in breach of data protection provisions (see also Art. 77 GDPR).

In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same per Art. 16, 17 Para. 1, 18 GDPR. However, this obligation does not apply if such notification is impossible or involves a disproportionate effort. Nevertheless, users have a right to information about these recipients.

Likewise, under Art. 21 GDPR, users and data subjects have the right to object to the controller’s future processing of their data pursuant to Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

III. Information about the data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose for its storage ceases to apply, provided the deletion of the same is not in breach of any statutory storage obligations or unless otherwise stipulated below.

Cookies

a) Our own cookies and similar storage

We use cookies on our website. Cookies are small text files or other storage technologies stored on your computer by your browser. These cookies process certain specific information about you, such as your browser, location data, or IP address.

This processing makes our website more user-friendly, efficient, and secure, allowing us, for example, to display our website in different languages, to keep you signed in to your MobX Games account, or to offer a shopping cart function.

Some of these cookies are session cookies that are deleted when you close your browser. In addition, when you play the games on this website or create a MobX Games account, we store a persistent first-party sign-in token in a cookie that is valid on mobx.games and its subdomains, so that your account and progress follow you across our games. Our games may also store a randomly generated device identifier and your game progress in your browser's local storage.

The legal basis for such processing is Art. 6 Para. 1 lit. b) GDPR, insofar as these cookies are used to collect data to initiate or process contractual relationships.

If the processing does not serve to initiate or process a contract, our legitimate interest lies in improving the functionality of our website. The legal basis is then Art. 6 Para. 1 lit. f) GDPR.

b) Third-party cookies

If necessary, our website may also use cookies from companies with whom we cooperate for the purpose of advertising, analyzing, or improving the features of our website.

c) Disabling cookies

You can refuse the use of cookies by changing the settings on your browser. Likewise, you can use the browser to delete cookies that have already been stored. However, the steps and measures required vary, depending on the browser you use. If you have any questions, please use the help function or consult the documentation for your browser or contact its maker for support.

If you prevent or restrict the installation of cookies, not all of the functions on our site may be fully usable.

Advertising (Google AdSense)

We finance the free games on this website through advertising. For this we use Google AdSense, including H5 Games Ads, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). When ads are served, Google and its partners use cookies and similar technologies to serve and measure ads and, where you have consented, to personalize them based on your visits to this and other websites.

If you are in the European Economic Area, the United Kingdom, or Switzerland, personalized advertising is only used with your consent, which we ask for through a consent banner. The legal basis is your consent per Art. 6 Para. 1 lit. a) GDPR. Without consent, only non-personalized ads are shown; these still use cookies for frequency capping, aggregated reporting, and fraud prevention. The legal basis for this is our legitimate interest in financing our free games per Art. 6 Para. 1 lit. f) GDPR.

You can review, change, or withdraw your consent at any time via the Privacy settings link, which is also available in the footer of this website.

Details on how Google processes data are available at policies.google.com/technologies/partner-sites. You can manage ad personalization in your Google account at adssettings.google.com and opt out of interest-based advertising by many other providers at youronlinechoices.eu or optout.aboutads.info.

Contact

If you contact us via email or the contact form, the data you provide will be used for the purpose of processing your request. We must have this data in order to process and answer your inquiry; otherwise we will not be able to answer it in full or at all.

The legal basis for this data processing is Art. 6 Para. 1 lit. b) GDPR.

Your data will be deleted once we have fully answered your inquiry and there is no further legal obligation to store your data, such as if an order or contract resulted therefrom.

Analytics (first-party)

We measure usage of our games and this site using our own first-party system hosted in the EU (Frankfurt, eu-central-1). It sets no cookies of its own, does not store your IP address, and shares no data with third-party analytics providers such as Google Analytics. Daily unique-visitor counts are derived from a salted hash that is discarded the same day.

If you play with a MobX Games account (see below), gameplay events such as session length, games played, and scores are recorded together with your randomly generated player ID, so that we can understand how our games are used. These events are pseudonymous: they never contain your email address or display name. Raw event records are deleted after 30 days; what remains are aggregate statistics that cannot identify you.

Game Accounts & Player Data

The games on this website use a shared MobX Games account so your progress follows you across our games and devices. When you first play, we automatically create an anonymous account identified by a randomly generated ID and gamertag — no email or personal information is required to play.

For each account we store: a randomly generated player ID and gamertag, your chosen display name, your game statistics and best scores, any cosmetic items you own, your friends list (see below), and a device authentication token. The legal basis is Art. 6 Para. 1 lit. b) GDPR (providing the game service you requested).

Leaderboards. Some of our games have online leaderboards. If you play signed in and set a score, your display name, gamertag, and score are stored and displayed publicly to other players. Scores from anonymous play are never published. The legal basis is Art. 6 Para. 1 lit. b) GDPR.

Friends. You can connect with other players as friends. We store your friend connections, pending friend requests, and any players you have blocked. Players who know your tag can send you a friend request, and your friends see your display name and best scores on friends leaderboards. The legal basis is Art. 6 Para. 1 lit. b) GDPR.

Email (optional). You may optionally connect an email address to your account so you can restore it on another device. If you do, we store your email address solely to send you a one-time verification code and to let you sign back in. We do not use it for marketing. The legal basis is Art. 6 Para. 1 lit. b) GDPR. Verification codes are sent via Amazon Web Services (AWS) Simple Email Service.

Retention. Anonymous accounts that have not been used for 90 days and have no email connected are automatically and permanently deleted. Accounts with a connected email are retained until you delete them.

Processing & storage. Player data is stored in Amazon Web Services (AWS) data centers (primarily the EU — Frankfurt region) and processed by AWS Lambda and DynamoDB on our behalf as a data processor.

Your right to erasure (Art. 17 GDPR). You can permanently delete your account and all associated data at any time: on this website, open the account menu and choose Delete account, or use the corresponding option inside our games where available. This immediately and irreversibly deletes your account, gamertag, statistics, leaderboard entries, friend connections and requests, owned cosmetics, connected email, and authentication tokens. You can also request deletion via the web at mobx.games/delete-account, or by emailing us (see the contact details above).
